The position will focus on Supporting and contributing the implementation, maintenance, and compliance of commercial activities. analyse, propose, and implement Global and local P&L procedures.
What will you do
- Contract Oversight Effective Governance ensures the portfolio of contracts in the business, follows best practice in contract and claim management methodologies, protecting the company's commercial interests while remaining in accordance with internal standard procedures.
- Procurement - Tender preparation, negotiation, recommendation and award. Review and comment on commercial and technical tender terms and conditions. Develop contract strategy based on Linxon's policies, project requirements, and the overall execution strategy taking into account risk, pricing, scope, and schedule. Purchasing Supports drafting of Purchase Orders, Services Agreements and Subcontracts ensuring that relevant (sub) contracts contain appropriate contract terms to protect Linxon's interest, including flow-down of main contract terms.
- Contract Administration - (from project kick-off to project closure) Identifies the contract baseline (including terms and conditions, specifications, drawings, estimate, proposal, schedule and other documents incorporated in the contract) and highlights areas of potential risk. Ensures timely and accurate execution of commercial aspects in portfolio of contracts (i.e. payments, claims, variation orders, warranties, provisions, guarantees, etc.). Support the Project Manager with guidance and drafting of all contractual correspondences towards customer.
- Subcontract Administration Effective administration of our domestic subcontractors to ensure the awarded scope is delivered as prescribed with all contractual obligations duly satisfied. Establish processes to ensure timely valuation, certification and payment.
- Change Management - Establishes and enforces standard change methodologies in portfolio of contracts to identify changes and quantify the additional time and compensation due to LINXON per the contract, defines approval requirements and communicates changes to the customer. Enforces and defends Linxons's contractual interests against customers and suppliers during the whole of a project lifecycle, including monitoring and assessment of changes and deviations, as well as defending and enforcing claims. In concert with Legal, develops the negotiation strategy and supports negotiations. Supports Legal in handling formal dispute resolution, litigation and arbitration including collation of contemporaneous records and co-ordinate with independent 3rd parties. Notifies and liaises with Legal to report major claims and keeps Legal updated of any critical development during project execution.
- Project Reporting In accordance with reporting schedule and in concert with Project Manager and functional teams prepare the Monthly Project Report which will include information pertaining to Schedule Status, Procurement Update, Cash Flow, Cost / Value Reconciliation, Risk & Opportunity Register.
- Risk management - Analyzes contract terms to highlight areas of potential opportunity and risk, such as ambiguities, omissions and conflicts, as work proceeds. Seeks advice from Legal to draft, negotiate and finalize agreements during the Sales and Project Execution phases. Develops and implements risk mitigation and opportunity plan in concert with Project Manager with regular reporting and early warnings being provided to Senior Management.
Experience, Education And Other Required
- Minimum 8+ years of experiences with master's or bachelor's degree.
- Act as the focal point for all SCM related activities.
- Knowledge of the commodities to be handled.
- Resilient, assertive, decisive, and confident.
- Leading by example, with strong values
- Strong Technical and commercial background, handling price negotiations, T&C, claims, supplier non-performance etc
- Ability to take initiative and apply both creativity and perseverance whilst remaining compliant with of Linxon's Code of Conduct and business ethics.
- Ability to stay calm, even if unforeseen events threaten to disrupt the situation.
- Business mindset to reach the business goals.
- Strong leadership and negotiating skills with an excellent ability to resolve issues, collaboration with team and work constructively to build positive relationships with all stake holders.
